Phoenix Non Compete Agreement Basics

A Non Compete Agreement prohibits an employee from working in a geographic area for a limited period of time in a specific job specialty.  Unreasonable non competition agreements can cause huge headaches for the employee once the employment contract is terminated and the post-employment non compete time period begins.  To clarify, a non compete agreement will prevent the employee from holding a specific position for a specific period of time in a specific area.  For instance, a physician may be prohibited from practicing in their specialty for twelve months within ten miles of the current office practice of the employer.  The restrictions contained in non compete agreements must be reasonable or a court could find it unenforceable and not legal.  Once you contact our law firm attorney, we can assist employees in Phoenix, AZ with fighting an unreasonable non compete or negotiating with the employer to reach a settlement over the rights of the non competition clause.  Arizona law does allow the enforcement of non compete agreements; however, whether the terms of the non-compete agreement are enforced depend upon several factors:

  • Did the employee benefit from the non-compete clause?
  • Does the non-compete clause violate Arizona public policy?
  • Is the non compete agreement narrow in scope and does it protect the employer’s legitimate business interests?
  • Whether the new agreement is reasonable in geographic limitation and temporal restriction

Non Compete Lawyer Assistance

We can review an employment contract prior to execution and determine whether it meets your needs and protects your ability to continue in your profession when the agreement is terminated. Our firm offers defense of claims that employees are in violation of the non-compete agreement contained in a new or existing employment contract.  Many on compete agreements reach far beyond the protection of a business’ legitimate business interests.  Legitimate business interests will include client/patient lists, practice policy, intellectual property rights and trade secrets.
