Our firm regularly provides representation to physicians and physician assistants before the Arizona Medical Board and the Arizona Board of Physician Assistants. One question that we get asked sometimes, is whether the boards are allowed to conceal the identity of a complainant to the licensee against whom the complaint is filed.
Under Arizona law, the boards are permitted to enter into written agreements with the complainants when the complaint is filed that conceals their identity from the licensee. The complainants are required, however, to indicate at the filing of the complaint that they wish to remain anonymous, as the complaints are sent out to the licensees fairly quickly after they are filed by complainants.
